Theory Test Rule Changes from 1 November 2026
From 1 November 2026 some learner permit holders must resit the driver theory test, there is no fifth permit and the minimum age becomes 15. Who is affected.
From 1 November 2026, new rules apply to learner permit holders in Ireland. The aim is to stop people renewing permits for years without taking a driving test.
For many learners the practical result is simple: you may have to sit the theory test again.
Who must resit the theory test
theorytest.ie lists three situations. Any one of them means a resit.
| Situation | Resit needed? |
|---|---|
| You are applying for a 3rd or 4th permit and have not taken a driving test in the previous 2 years | Yes |
| You have already held 4 learner permits | Yes. No 5th permit is allowed, unless you were medically restricted |
| Your learner permit has been expired for 2 years or more | Yes |
Not sure where you stand? Use the resit checker. It takes three questions.
Permit by permit
| Permit | Rule from 1 November 2026 |
|---|---|
| 1st | Normally valid for 2 years |
| 2nd | Normally valid for 2 years |
| 3rd | Renew without a resit only if you took a driving test in the past 2 years |
| 4th | Same condition as the 3rd, and it lasts only 1 year |
| 5th | Not allowed, unless medically restricted. Resit the theory test |
theorytest.ie notes that four permits add up to around seven years as a learner.
Who the rules cover
According to Citizens Information, the changes apply to cars (B), work vehicles (W), motorcycles and mopeds. They apply when you renew after 1 November 2026.
If your permit expires close to that date, check the NDLS before deciding when to renew.
Three quick examples
Aoife is renewing her 1st permit. The new rules do not affect her, as long as the permit has not been expired for 2 years or more.
Ben is applying for his 3rd permit and took a driving test 8 months ago. He meets the condition and can renew without a resit.
Ciara is applying for her 3rd permit and has never booked a driving test. She must resit the theory test first.
Minimum age of 15
From 1 November 2026 the minimum age to sit the driver theory test is 15, according to the theorytest.ie FAQ.
The site shows two dates. A banner says that from 5 May 2026 candidates are recommended to be at least 15 on the test date.
| Date | What theorytest.ie says |
|---|---|
| 5 May 2026 | Recommended: at least 15 on the test date |
| 1 November 2026 | Minimum age of 15 to sit the test |
What to do now
- Count your permits. If unsure, check with the NDLS.
- Find the date of your last driving test. It must be within 2 years.
- Check your permit’s expiry date. Expired for 2 years or more means a resit.
- Book your driving test early if you are on your 2nd permit. That protects your 3rd renewal.
- Prepare properly if you need to resit. It is the same test: 40 questions, 35 to pass, €45 per attempt.
Practise before you resit
